France's social security financing law for 2026: generics out of the clawback, discount caps, and biosimilar substitution levers

The law of 30 December 2025 takes generics, hybrids and biosimilars out of the base of the safeguard clawback, caps the commercial discounts pharmacies may receive on them from 1 January 2026, ties third-party payment to substitution, and shortens the delay before a reference price applies to a new generic group. What changes for generics makers, pharmacies and anyone pricing against the French list.

What changed

France’s annual social security financing law is where medicines pricing policy is made. The law for 2026, number 2025-1403 of 30 December 2025, carries four changes that matter to the off-patent market.

Generics leave the clawback. The safeguard clause (clause de sauvegarde) claws back from manufacturers a share of reimbursed medicines spending above an annual threshold. For 2026 the threshold is €22.10 billion, and generics, hybrids and biosimilars are excluded from the base: their sales no longer count towards the threshold and they pay no share of the clawback. The clawback becomes a tax on originators only.

Discounts to pharmacies are capped. From 1 January 2026 the commercial discounts, rebates and benefits a pharmacy may receive are capped by law at 40% of the ex-factory price for substitutable generics and hybrids and 20% for substitutable biosimilars. A report on the effects is due to Parliament by 1 October 2027.

Third-party payment against substitution. The “tiers payant”, under which the patient pays nothing at the counter, is conditional on accepting the substitutable biosimilar or hybrid, as it already is for generics.

The reference price arrives sooner. The delay before a reference reimbursement price (tarif forfaitaire de responsabilité) can be set for a generic group is cut to one year for groups whose first generic price is published from 1 September 2026. The reference price is the mechanism that caps reimbursement at the generic level for the whole group, brand included.

What it means if you are…

A parallel trader. France is a source market more than a destination, and the changes here bear on the French list price of originators and on how fast the originator’s reimbursement falls to the generic level once a generic launches. A one-year path to the reference price means an originator’s reimbursable price in France converges on the generic a year after generic launch rather than later, which compresses the window in which French-sourced original product is both cheap and still fully reimbursed elsewhere.

A generics or launch planner. The discount caps are the big change in the French generics business, where competition has run on the size of the discount to the pharmacy rather than on list price. A legal cap at 40% (20% for biosimilars) changes the economics of winning pharmacy listings and favours companies that compete on service and supply. Leaving the clawback removes a liability that was becoming material for large generics portfolios. The faster reference price makes the first year after launch the decisive one for share.

A buyer or pharmacy. Less discount income from generics and biosimilars; stronger push to substitute, since the patient’s exemption from paying at the counter depends on it.

What to watch

The 2027 financing law, which will revisit the thresholds and may extend the discount caps; the report due in October 2027; and implementing decrees on the substitution rules for hybrids and biosimilars, which the pharmacists’ order lists among the measures still to be detailed.
